Hybrid Trust - Deed of Confirmation
To be used after you have sought legal advice on whether the signing of this document will constitute a resettlement of the Unit Trust.
Whether there is a resettlement or not is impossible to consider since we have not met with the ultimate client, nor reviewed any documents relevant to the trust and have no understanding of what assets are in the trust. It is our usual practise before drafting a Deed of Confirmation to meet with the client and ask a series of questions. This cannot be achieved here. It is our strong opinion that you seek legal advice before proceeding to sign this document to ensure that it meets your needs and does not expose the Trust to either stamp duty or capital gains tax consequences.
